Meta’s Self Serve Ad Terms [Effective 3 January 2023]

Social Media’s already known as a place where endless updates and terms goes effective with or without prior notice. Hence, it is important to be well informed, especially if you are a ads manager!

The following terms (“Self-serve Advertising Terms” or “Self-serve Ad Terms”) apply to your use of Meta Products (such as self-service advertising interfaces and APIs) for the creation, submission, and/or delivery of any advertising or other commercial or sponsored activity or content (collectively, “Self-serve Ad Interfaces”), as well as any order placed through the Self-serve Ad Interfaces (“Order”).

You can reach your target audience by purchasing advertisements that will be distributed on Facebook, Messenger, Instagram, our publisher network, or anywhere else we serve ads.

1. When you place an Order, you will tell us what type of advertising you want to purchase, how much money you want to spend, and your bid. If we approve your Order, your advertising will be sent as inventory becomes available. Subject to Section 5, when serving your ad, we utilise our best efforts to deliver the advertisements to the audience you designate or to accomplish the outcome you select, but we cannot promise that your ad will reach its intended target or achieve the outcome you chose in every instance.

2. All applicable laws, regulations, and guidelines, as well as our Advertising Policies, must be followed by your advertisements. Failure to comply may result in a number of penalties, including the cancellation of your advertisements and the termination of your account.

3. We reserve the right to refuse or remove any advertisement for any reason.

4. You will pay for your Orders in the following ways:

a) To the extent applicable, you will follow our Community Payments Terms.

b) You agree to pay all sums specified in each Order, as well as any applicable taxes. Our tracking technologies will determine how much you owe for each Order.

c) By submitting an Order, you authorise us to receive your personal and/or company credit report from a credit bureau, either at the time of submission or at any time subsequently.

d) You are responsible for the security of your advertising account, and you accept that any Orders placed on or via your advertising account will be charged to you.

e) If you pay by direct debit, you agree that we may charge you any amount that falls within the range that you agreed to when you signed up. We will notify you beforehand if any charge will exceed the agreed-upon range.

f) You can cancel an Order at any time, but your advertisements will continue to run for 24 hours after you contact us, and you will be charged for all ads that run.

g) The charges we make to you may be subject to and include applicable taxes and levies, including, but not limited to, withholding taxes. Any taxes that apply to your transactions are your responsibility to bear and remit. You will indemnify and hold us blameless for any claim that arises as a result of your failure to do so.

h) If your payment method fails or your account becomes overdue, we may take extra actions to collect the outstanding balance. You agree to pay all collection expenses, including reasonable legal fees.Past-due balances will be charged interest at the rate of 1% per month or the legal maximum, whichever is less.

i) We may allow you to buy ads using a “Advertiser Balance,” which is a pre-paid balance that can only be used to buy ads on Meta. Advertiser Balances can only be used for commercial or corporate purposes. Except when required by legislation, Advertiser Balances are non-refundable. Because Facebook is not a bank and does not provide banking services, Advertiser Balances do not earn interest, are not deposit obligations, and are not insured by the Federal Deposit Insurance Corporation, the Financial Services Compensation Scheme, or any other governmental or private entity or insurance scheme.

j) Depending on your payment method, you will fall into one of two categories: invoiced or non-invoiced client. Invoiced clients are those for which Meta establishes a maximum spending limit and sends out invoices on a regular basis in compliance with the appropriate invoicing conditions. Non-invoiced customers are those who must pay at the moment of purchase. Meta may categorise clients as invoiced clients at its exclusive discretion depending on variables such as ad expenditure and creditworthiness.

5. You acknowledge that we conduct tests on our Self-serve Ad Interfaces and related systems from time to time, which may affect your use and experience, including campaign performance. You recognise and agree that we may conduct tests as specified in these Terms, including tests to evaluate formatting, relevance, pricing, reporting, targeting, and delivery.

6. We will decide on the size, location, and positioning of your advertisements.

7. Delivery scheduling is subject to availability and may not be continuous.

8. We do not guarantee the reach or performance of your advertising, such as the number of people who will see them or the amount of clicks they will receive.

9. We cannot control how clicks are generated on your ads. We have systems that attempt to detect and filter certain click activity, but we are not responsible for click fraud, technological issues or other potentially invalid click activity that may affect the cost of running ads.

10. Our licence to deliver your ad will end when we have completed your Order. You understand, however, that:

a) Once displayed, ads are public information. Ads may be re-shared and accessed outside of the targeted audience (including from the Facebook Page or profile or Instagram Professional Account running the ads or within Meta Products). If users interact with your ad, it may remain on our Products (e.g. shared until the users delete it, or visible to users through their account tools).

b) If your ad is about social issues, elections, or politics, Meta may display (at no cost to you) and provide access to the ad content and creative, as well as information about the ad campaign (such as total spend and delivery data, and targeting information) for seven years after your order is completed.

c) You agree that Meta may reveal your advertising material, as well as all information related to your advertising, to a governmental organisation or body if Meta thinks that disclosure may aid in a legitimate inquiry.

11. We will offer you with information on who is viewing your advertising and how well they are doing. The Data Use Restrictions in our Advertising Policies apply to your use of these reports. We may give a business and all individuals who advertise for the business with information regarding the quantity of advertising that are being run for the business throughout the Meta Products, as well as any limits on those ads.

12. We provide tools to our users to enable transparency about how Meta advertising works and control over their ad experience, including enough information to show them why they are being served certain advertisements. You acknowledge that information related to your advertising may be included in these tools, and that these tools may influence your ability to market to those people or prohibit them from seeing your advertisements.

13. You shall not publish any press releases or make public remarks about your connection with Meta or the Meta Products without our prior written authorization.

14. If you are running advertising on someone else’s behalf, you must obtain authorization to do so and agree to the following:

a) You represent and warrant that you have the power to bind the advertiser to these Self-serve Ad Terms and the Terms of Service, as well as the Commercial Terms, to which you also agree.

b) If the advertiser you represent breaches these Self-serve Ad Terms, the Terms of Service, or the Commercial Terms, we may hold you liable.

c) You agree that we may share campaign reporting information to the final advertiser, whom you targeted for advertisement.

15. We may request that you examine and accept additional conditions that pertain to your usage of a certain feature or capability made accessible through the Self-service Ad Interfaces. To the extent that such additional terms contradict with these Self-serve Ad Terms, the supplemental terms will take precedence over your usage of the relevant service or capability. We reserve the right to amend or update these Self-serve Ad Terms at any time, and your continuing use of the Self-serve Ad Interfaces represents your acceptance of any changes.

16. Contracting party: 

a) Meta Platforms, Inc. supplies the Self-serve Ad Interfaces if you reside or have your primary place of business in the United States or Canada.

b) Meta Platforms Ireland Limited provides Self-serve Ad Interfaces if you live or have your primary place of business outside of the United States or Canada.

c) Notwithstanding the above, advertisers in some countries may be subject to specific conditions regarding Orders they make, including, in some cases, that they engage directly with Meta affiliate firms only for the purpose of placing Orders. If these particular provisions apply to your Orders, you may discover them here.

d) To avoid confusion, regardless of which entity you contract with (as described in Sections 16.a, 16.b, and 16.c), Meta’s Advertising Policies (and its Community Standards as incorporated) are enforced under the Terms of Service by the entity that provides the Meta Products in your region under the applicable Terms of Service.

17. Any claim, right of action, or dispute arising out of or relating to these Self-serve Ad Terms is subject to the Commercial Terms’ dispute resolution section.

18. If the Commercial Terms are terminated, these Self-serve Ad Terms will be terminated as well, but the following sections will remain in effect: the lead-in paragraph and Sections 2, 4, 8-12, and 15-18.
